Collection and Use

privacy statement discloses the privacy practices for the

refer to TOUCHPOLL, INC., the owners of
TouchPollWEB™, their affiliates, officers, directors,
employees, agents, and representatives (collectively, "TOUCHPOLL,
INC.").
Information Gathered by TOUCHPOLL, INC.
TOUCHPOLL, INC. collects information from our users at several
different points on our website, and that information is
subject to our control and this Policy. While we also collect
certain information on this site to make it and our services
more secure, error-free, relevant and effective, we will
not sell, share, or rent the information that we collect
for our own use to others in ways different from what is
disclosed in this Privacy Policy.
Users must understand that the very nature of our
service means that other organizations and individuals use
our site to collect information through survey questionnaires.
TOUCHPOLL, INC. controls only our own use of information
that we collect; other entities who collect information
through our surveys may have their own different policies
regarding the information they collect through survey questionnaires.
Concerned users should check with the surveying organization
to learn its privacy policy.
Collection Of Information
By Third-Parties
Some of our site(s) and service(s) contain links to other
sites whose information practices may be different than
ours. Visitors should consult the other sites' privacy policies
as we have no control over information that is submitted
to, or collected by, these third parties (see the section
below entitled "Links").
Although we take appropriate measures to safeguard
against unauthorized disclosures of information, we cannot
assure you that personally identifiable information that
we collect will never be disclosed in a manner that is inconsistent
with this privacy policy.
Unfortunately, despite all of our best efforts, there is
always a risk that third parties may unlawfully intercept
transmissions (see "Disclaimer" at the end of
this Notice). This reality is true of all Internet use.
As a result, we cannot ensure the security of any information
you transmit, and you transmit all information at your own
risk.
Registration
In order to use this website, a user must first complete
a registration form. During registration users who register
for survey creation (survey makers) are required to give
their contact information (such as name and e-mail address,
title, and company). We use this information in order to
contact the user about the services on our site in which
he/she has expressed interest. Survey makers may have their
IP addresses (unique network identifying numbers) recorded
in order to prevent fraud or misuse.
People who use this site only to take surveys (survey takers)
engage in a procedure different from that undertaken by
those that use our service to create surveys. Takers of
surveys created by survey makers will not be required to
register with or give to TOUCHPOLL, INC. particular "identifying"
data. In the course of filling out surveys, however, survey
takers may elect to enter personally identifiable information,
which TOUCHPOLL, INC. will release only to the survey maker,
subject to the exceptions below. In order to ensure that
surveying is done in a fair, just, and scientific manner,
TOUCHPOLL, INC. may record the IP addresses of survey takers.
NOTE: Individual IP addresses may be released outside of
TOUCHPOLL, INC., in the course of our providing the results
of non-Anonymous surveys to survey makers. Takers of Anonymous
surveys will never have their IP addresses released to survey
makers. Other releases of IP address information may occur
only as otherwise provided for under the Exceptions section
of this Privacy Policy.
Activation
We request information from the survey maker on our activation
page. There, a user must provide contact information (such
as name and shipping address) and financial information
(i.e. credit card number, expiration date, billing address,
and purchase order number). This information is used for
billing purposes only and to fill customer orders. If we
experience difficulty during order processing, we then reference
this contact information in order to contact the user. We
transmit certain standard payment information (card number,
address) to credit card and financial institutions in order
to process requested payments; such data then becomes subject
to those companies’ use of the same.
Log Files
We use IP addresses to analyze trends, administer the site,
track users' movement, prevent unauthorized tampering with
our services, and gather broad demographic information on
aggregate usage patterns. IP addresses are not generally
linked to personally identifiable information, although
they may be recorded in transaction log files to aid in
security auditing. Log files include IP address, domain
name, pages visited, access times, browser type, referring
pages, and other information that is contained within a
normal web page request.
Sharing and Selling Information
We may elect to share aggregated demographic information
about survey takers with our partners and customers. Our
aggregate information does not include individualized, personal
information that could be used to identify any individual
person. Rather, such information contains broad statements
about the characteristics of our survey taking pools.
We use credit card processing service partners to bill users
for our services. These are reputable, major companies who
use information that we pass to them to provide financial
services in the normal course of business.
Survey takers' responses to surveys hosted on behalf of
our customers become the property of our customers. We will
provide the response data to our customers, and nobody else
(subject to the exceptions below). However, our customers
may elect to share or sell information that is their property.
We encourage you to read our customers’ respective
applicable privacy policies, because they may differ from
ours.
Information that we at TOUCHPOLL, INC. collect our own surveys
or via other means, may be shared with our customers, strategic
partners, investors, or suppliers, in aggregate form. We
will not sell users' personal data, such as users’
names and e-mail addresses.

This web site contains links to other sites. Please be aware
that we, TOUCHPOLL, INC., are not responsible for the privacy
practices of such other sites. We encourage our users to
be aware when they leave our site and to read the privacy
statements of each and every web site that collects personally-identifiable
information. This Privacy Policy applies solely to information
collected through this particular TOUCHPOLL, INC. website,
http://www.TOUCHPOLL.com.
Surveys
Our site contains a number of survey questionnaires that
are hosted by TOUCHPOLL, INC. on behalf of our customers,
the survey makers. Your participation in these surveys is
completely voluntary. Therefore, you, the user, have a choice
whether or not to disclose this information. The information
that may be requested might include personally-identifiable
information. We remind you that TOUCHPOLL, INC. has no control
over the information that is requested by our customers
or submitted to them independently by you. Nevertheless,
the information that we acquire from surveys that we conduct
at TOUCHPOLL, INC. for our own use will be subject to this
Privacy Policy and our internal use policies.
Anonymous Surveys
At the surveyor's request, TOUCHPOLL, INC. does provide
mechanisms to help mask the identities of our survey respondents
from our customers, the surveyors. Such surveys will include
a notice that the survey data is being stored anonymously
(i.e., without the normal association of an e-mail address
or some other unique personal identifier). These mechanisms
are technological in nature, and insure only that the numbers
identifying the responder do not directly correlate to individually-identifiable
information. Survey respondents must remain vigilant of
the fact that providing personally-identifiable information
in response to a survey questionnaire will circumvent any
identity masking that TOUCHPOLL, INC. could otherwise provide.
Furthermore, surveys that do not give express notice of
anonymity may in fact allow customers to link a survey taker's
responses to his or her e-mail address or other identifier.
Survey takers should exercise care concerning which surveys
they choose to complete.
If you believe that a survey maker who has claimed to be
conducting an anonymous survey might be attempting to circumvent
these privacy and anonymity mechanisms, please notify us
immediately and be prepared to provide us with as much detail
as is possible.
Security
TOUCHPOLL, INC. takes special care to protect our users'
information. When users submit sensitive information via
our website, your information is protected both online and
off-line.
When our order form asks users to enter sensitive information
(such as credit card number), that information is encrypted
and is protected with the best encryption software in the
industry - - currently, Secure Sockets Layer (SSL), authenticated
with a digital certificate. You will see an indication that
the page you are visiting is deemed secure when a lock-shaped
icon appears on a secure page (such as our order form) at
the bottom of popular Web browsers; this icon will appear
"locked" (as opposed to an "unlocked"
icon that appears when you access non-secure pages).
We compartmentalize and quarantine our surveying data and
billing data, and keep them separate from one another which
thereby increases protection. Only employees who need the
information to perform a specific authorized task (for example,
billing or customer service) are granted access to personally-identifiable
information. All employees are kept up-to-date on our security
and privacy practices. Every quarter, as well as any time
new policies are added, our employees are notified and reminded
of the importance that TOUCHPOLL, INC. places on privacy,
and what they can do to continue to ensure that our customers'
information remains protected. Finally, our servers (within
which personally-identifiable information is stored) are
kept in a secure, monitored facility.
Site and Billing Announcements
We may also periodically send site and billing announcements
to our customers. Customers will be unable to un-subscribe
from these announcements, as they contain important information
concerning our service or the user's account. We must be
able to communicate with the user to provide requested services
and in regards to issues relating to their account via e-mail
or the web. These announcements will be limited in content
to information concerning our services, or the user's account,
and they will not contain any promotional or marketing material.
Correcting / Updating Personal Information
If a user's personally-identifiable information changes
(such as their zip code), or if a user no longer desires
to use our service, we will utilize an updating system to
incorporate and act upon the user's personal data provided
to us. This can be performed at our User Account editor
page, or by notifying our customer support personnel.
Customers' Data and E-mail
Lists
In the course of providing services, TOUCHPOLL, INC. may
receive data from customers, or to be sent to its customers,
including but not limited to questions, response data, and
e-mail lists for invitations. TOUCHPOLL, INC. will not use
specific questions or e-mail addresses for purposes other
than for providing service to the customer. Specifically,
we do not use or sell e-mail addresses to which invitations
have been sent using TOUCHPOLL, INC.'s e-mail invitation
system. Please note, however, that TOUCHPOLL, INC. does
use aggregate information regarding questions, responses,
and e-mails to learn about and improve how our service works.
For example, we may measure the response rates to e-mail
invitations, or how the position of a question on a page
affects its response rate, but we will not use specific
questions, responses, or e-mail addresses without your permission.
EXCEPTIONS
Nothing in this Privacy Policy or the User Agreement may
be construed as stopping or inhibiting TOUCHPOLL, INC.'s
cooperation with law enforcement, investigative agencies
or court orders. Furthermore, nothing in this Privacy Policy
shall restrain TOUCHPOLL, INC. from investigating and prosecuting
any users of our site who attempt to defraud or damage us,
or who violate our User Agreements. Therefore, TOUCHPOLL,
INC. may share otherwise protected data with law enforcement
or investigative agencies, or as directed by court order.
Also, when necessary to diagnose and repair technical problems,
TOUCHPOLL, INC. may examine or change any data, computer
code, or other information. Such examinations and changes
will be restricted to technical personnel with a need to
know.
Notification of Changes
If we decide to change our Privacy Policy, we will post
those changes on our site so that our users are always aware
of what information we collect, how we use it, and under
what circumstances - if any - that we disclose it. If at
any point we decide to use personally-identifiable information
in a manner different from that stated at the time it was
collected, we will notify users by e-mail. Based upon information
contained in this e-mail notice, Users will then have a
choice to opt out of the changes, if they disagree with
how we propose to use their information in this different
manner. We will honor users’ choices, and will agree
to use user information in accordance with the Privacy Policy
under which the information was originally collected, at
the user’s election.
DISCLAIMER
While TOUCHPOLL, INC. agrees to maintain certain security
measures to protect User information, TOUCHPOLL, INC. cannot
be responsible for the release of User information caused
by hacking or another user's tampering with the TOUCHPOLL,
INC. website. Users assume the risk that any information
that they have submitted, however secure, may be illegally
misappropriated by others. TOUCHPOLL, INC. agrees to fully
cooperate with law enforcement to protect and retrieve any
information that may be illegally misappropriated by others.
